These Terms of Use ("Terms") govern your access to and use of our proprietary Digital Twin platform, website, API, and related services (collectively, the "Service").VisualityX provides visualization, simulation, and asset management solutions for factories, real estate, and other industrial or commercial assets.By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

Subject to your compliance with these Terms and payment of applicable fees, VisualityX grants you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business operations.
3.2 Customer Data License
You retain all ownership rights to your Customer Data (e.g., your factory blueprints or building models). By uploading Customer Data, you grant VisualityX a worldwide, royalty-free license to use, host, store, and display such data solely as necessary to provide the Service to you (e.g., to render the Digital Twin). We do not claim ownership of your physical assets or their digital representations.
4. Intellectual Property Rights
4.1 Company IP
The Service, including its "look and feel," rendering technologies, simulation algorithms, code, and interface, is the exclusive property of VisualityX.
4.2 Feedback
If you provide suggestions or feedback regarding the Service, VisualityX shall be free to use such feedback for any purpose without obligation or compensation to you.
5. Confidentiality and Data Security
5.1 Confidentiality
We acknowledge that Customer Data may contain sensitive industrial trade secrets, floor plans, or security protocols. VisualityX agrees to maintain reasonable administrative, physical, and technical safeguards to protect the security and confidentiality of Customer Data.
5.2 Aggregated Data
We may collect and use aggregated, anonymized data derived from the use of the Service for industry analysis, benchmarking, and analytics, provided that such data does not identify you or your specific assets.

While VisualityX strives for high-fidelity accuracy, Digital Twins are simulations based on provided data. We do not guarantee that the Digital Twin will perfectly reflect the current physical state of any asset at all times.

The Service is a visualization and management tool. It does not constitute professional engineering, structural, or safety advice. Decisions regarding the operation, maintenance, or construction of physical assets based on the Service are your sole responsibility.
6.3 Safety Critical Systems
You acknowledge that the Service is not designed to be used as a fail-safe or real-time control system for hazardous environments, life-support systems, or immediate safety-critical machinery controls where failure could lead to death, personal injury, or environmental damage.

To the maximum extent permitted by law, VisualityX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of production, factory downtime, equipment damage, or loss of profits.Our total liability for any claims arising out of these Terms shall be limited to the amount you paid us to use the Service in the twelve (12) months prior to the act that gave rise to the liability.

- Upload data involving sensitive government or military facilities without prior written authorization and compliance with specific regulations (e.g., ITAR, EAR).
- Reverse engineer our rendering pipeline or API.
- Use the Service to simulate illegal activities or identifying security vulnerabilities in third-party structures without authorization.
- Overburden the Service infrastructure with excessive IoT data streams beyond your subscription limits.
8. Limitation of Liability

- You are entitled to retrieve your Customer Data within thirty (30) days, after which we may delete it from our systems.
